Terms & Conditions

Effective 5th June 2026

These Terms govern access to and use of the Perx platform, including the myPerx mobile application on the Apple App Store and Google Play Store.

By downloading, registering for, accessing, or using myPerx or any related Perx services, you acknowledge that you have read, understood, and agreed to be bound by these Terms, together with any related policies, notices, campaign rules, and operational guidelines published by Perx from time to time.

Definitions and Interpretation

For the purposes of these Terms:

Perx means the customer engagement, loyalty, rewards, and retention platform operated by Perx Technologies.

myPerx means the official customer-facing mobile application of Perx available on authorized app marketplaces.

Perx Technologies means the owner and operator of the Perx platform and myPerx application.

Merchant means any business or entity registered on Perx for the purpose of creating, managing, and offering customer campaigns, rewards, or promotional programs.

Customer means any individual registered on myPerx to participate in campaigns and access rewards.

Campaign means any promotional initiative, reward mechanism, referral program, incentive structure, or customer engagement activity created by either Perx or a Merchant.

Rewards means any benefit, voucher, cashback, discount, promotional value, points, or incentives offered through the Platform.

Perx Points means global reward points established and administered directly by Perx Technologies.

Platform means the applications, dashboards, interfaces, APIs, systems, and associated services operated by Perx.

Nature of the Platform

Perx provides technology infrastructure enabling Merchants to create and manage customer loyalty and engagement campaigns.

Perx facilitates interactions between Merchants and Customers but does not, unless expressly stated otherwise, assume responsibility for Merchant issued products, services, reward fulfilment, or campaign execution.

Perx may independently launch platform-wide promotions, offers, and reward initiatives directly through myPerx, including Perx Points programs, Spin & Win activities, referral campaigns, and other engagement-based initiatives.

Registration and Eligibility

Users must provide accurate, complete, and up-to-date information during registration and throughout continued use of the Platform.

Each user is solely responsible for maintaining the confidentiality of account credentials and all activity conducted under their account.

Perx reserves the right to:

  • Verify registration details
  • Request additional supporting documentation
  • Reject, suspend, or terminate account registrations
  • Restrict access where necessary for compliance, operational, or security reasons

Users must promptly notify Perx of any unauthorized access or suspected misuse.

Merchant Access and Usage Rights

Subject to compliance with these Terms, Merchants are granted a limited, revocable, non-exclusive, and non-transferable right to access Perx solely for legitimate business purposes.

Merchants shall not:

  • Reverse engineer, copy, or replicate Platform functionality
  • Attempt unauthorized access to Platform infrastructure
  • Introduce malicious software or harmful code
  • Use customer data beyond authorized operational purposes
  • Misrepresent rewards, campaigns, or promotional conditions
  • Use the Platform for unlawful or deceptive activities

Perx may immediately suspend Merchant access where misuse or abuse is identified.

Campaigns and Rewards

Merchants remain fully responsible for all Merchant-created campaigns offered through Perx.

This responsibility includes campaign design, reward conditions, customer-facing communications, legal compliance, and reward fulfilment.

Merchants warrant that all rewards made available through the Platform are lawful, accurately represented, and capable of fulfilment.

Perx reserves the right to review, monitor, restrict, suspend, or remove campaigns that present operational, financial, reputational, or compliance risks.

Perx Points

Perx Technologies may establish and administer Perx Points as a platform-wide reward mechanism.

Perx Points may be earned through various activities determined by Perx, including promotional participation, referral programs, Spin & Win activities, customer engagement initiatives, or limited-time campaigns.

Perx reserves the sole right to determine:

  • Point earning criteria
  • Accrual rates
  • Redemption eligibility
  • Point expiry periods
  • Conversion values
  • Program limitations or restrictions

Perx Points are non-transferable and hold no monetary value unless expressly stated otherwise.

Perx may modify, suspend, reverse, expire, or discontinue Perx Points where necessary due to operational requirements, fraud prevention measures, technical corrections, or strategic business changes.

Customer Responsibilities

Customers agree to use myPerx lawfully and fairly.

Customers must not:

  • Create duplicate accounts for unfair benefit
  • Manipulate campaign mechanics
  • Exploit technical loopholes
  • Submit false or misleading information
  • Engage in fraudulent redemption activity

Perx reserves the right to investigate suspicious activity and take corrective action, including reward reversal, account suspension, or permanent termination.

Redemption and Reward Fulfilment

Reward redemption is subject to campaign-specific terms, eligibility requirements, and availability.

Merchant-issued rewards remain the sole responsibility of the issuing Merchant.

Perx shall not be liable for:

  • Merchant refusal to honour rewards
  • Inventory limitations
  • Delayed reward fulfilment
  • Product or service quality disputes

Perx-issued rewards, including Perx Points redemption options, shall be governed by redemption conditions published within myPerx.

Perx may reverse rewards or points where issued due to fraud, abuse, technical malfunction, duplicate processing, charge reversals, or breach of these Terms.

Communications

By registering on myPerx, users consent to receive communications relating to:

  • Service updates
  • Reward notifications
  • Campaign announcements
  • Promotional offers
  • Operational alerts
  • Platform support communications

Users may manage communication preferences where such functionality is provided.

Data and Privacy

Perx may collect, store, process, and analyse user and transaction data for operational purposes including service delivery, reward administration, fraud prevention, analytics, and platform enhancement.

Perx may also use anonymized and aggregated data for service optimization and business intelligence purposes.

All data handling shall be subject to applicable privacy policies and relevant legal obligations.

Fees and Charges

Merchants may be subject to subscription fees, service charges, campaign-related fees, or other commercial arrangements agreed separately with Perx.

Unless expressly stated otherwise, Customers are not charged to use myPerx.

All Merchant fees are non-refundable unless otherwise agreed in writing.

Intellectual Property

All intellectual property rights in Perx, myPerx, associated software, interfaces, branding, and content remain the exclusive property of Perx Technologies.

No ownership rights are transferred to users except for the limited usage rights expressly granted under these Terms.

Suspension and Termination

Perx may suspend or terminate access where:

  • These Terms are breached
  • Fraudulent activity is suspected
  • Security risks are identified
  • Compliance obligations require restriction
  • User conduct threatens Platform integrity

Termination shall not relieve Merchants of outstanding reward fulfilment obligations.

Disclaimer of Warranties

The Platform is provided on an “as available” and “as is” basis.

Perx does not guarantee uninterrupted service availability, continuous access, or error-free functionality.

Limitation of Liability

To the fullest extent permitted by law, Perx shall not be liable for any indirect, incidental, special, or consequential damages, including loss of revenue, profits, goodwill, customer relationships, or data.

Perx shall not be liable for disputes arising directly between Merchants and Customers.

Indemnity

Users agree to indemnify and hold harmless Perx Technologies against claims, damages, liabilities, and costs arising from:

  • Breach of these Terms
  • Misuse of the Platform
  • Fraudulent conduct
  • Violation of applicable law

Amendments

Perx reserves the right to amend these Terms at any time.

Updated Terms shall take effect upon publication within the Platform or official communication channels.

Continued use of Perx following such publication constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Maldives.

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Maldives.
